Kansas statutes call the role a resident agent, but it is the same job every state requires: a registered agent at a Kansas street address who accepts legal documents for your business. Swapping yours takes one filing with the Kansas Secretary of State, Form ROA, and a state fee of $30 online or $35 on paper. Here is the whole process, start to finish.

The Kansas Change of Agent Form: ROA

The official form name and number is the Certificate of Amendment, Change of Resident Agent and/or Registered Office, Form ROA. You can download Form ROA from the Secretary of State's site and mail it to Business Services in Topeka, or skip paper entirely and file through the Change a Business tool at sos.ks.gov.

A note on the fee, because older write-ups disagree. The statute sets a $20 base for this certificate (K.S.A. 17-76,136(a)(1)(D)), which is where the $20 figure you see quoted comes from. With the state's add-on fees, what for-profit entities actually pay is $30 online or $35 on paper. Not-for-profit corporations pay $20.

Two Kansas quirks worth knowing before you file:

  • The biennial Information Report has no registered agent field, so you cannot fold an agent change into that filing. It always takes its own form.
  • Companion forms exist for the other direction. Form RGO handles a change submitted by the agent, and Form RAN is an agent's resignation without a successor.

Why Change Your Registered Agent?

Business owners switch agents for several reasons:

Privacy Concerns If you've been using your home address, it appears on public state records. Switching to a professional service keeps your personal address private.

Reliability Issues Your agent needs to be available during business hours to receive documents. If your current agent misses important notices or forwards documents late, you may face compliance problems.

Price Many services charge between $125 and $436 per year. Switching to a more affordable option can reduce ongoing expenses without sacrificing service quality.

Relocation If you move out of Kansas or your agent relocates, you'll need a new agent with a physical Kansas address.

Business Changes If you started as your own agent but want to separate your personal information from public filings, a professional service provides that separation.

  1. Choose a new registered agent who meets Kansas requirements. Under K.S.A. 17-7925 that can be an individual Kansas resident, a business entity authorized in the state, or even the entity itself. Whoever you pick needs a physical Kansas street address, not a PO box, and availability during normal business hours.
  2. Complete Form ROA with your entity's name plus the new agent's name and registered office address, or enter the same details in the online Change a Business tool.
  3. Submit the filing to the Kansas Secretary of State and pay the fee: $30 online, $35 by mail.
  4. Verify the change. Once the state processes the filing, look up your entity in the Secretary of State's business records and confirm the new agent is listed.
